Our Terms of Service

Introduction

For the purpose of clarity, CCA Systems and all its associated tools are referred to as “the Service” or “this Service” for all sections of this document. The words “We”, “we” and “us” in this document refers to the managers of CCA Systems.


Registering with this Service

Creating an account for the purpose of using this service implies that the terms outlined in this document and those of the Privacy Policy are accepted by you and users associated with your account.

The email address used in the registration form is called the “primary user” of the registered account. The primary user has sole responsibility for the actions of other account users. This service will not be liable for breaches relating to the activities of the primary user or other users associated with the account in question. It is important that the primary user understands how to Manage Users , especially the process of assigning designations and administrator roles to other users.

All accounts registered for the purpose of using this service are prohibited from engaging in activities which may be deemed unlawful, intended to damage this service or interfere with the activities of other registered users.

Transferring the services of your account to another organization is not allowed.

Non adherence to any of the above is grounds for closing such an account without notice.


Account Subscription, Renewal and Expiration

All newly registered accounts are automatically subscribed to the Trial package which is valid for a 30-day period. To use this service beyond the trial period, an account must be upgraded to a paid subscription package. See here for more information on the available subscriptions. All paid subscription packages are valid for a 365-day period. At the end of this period the primary user has the option of renewing the expired subscription or subscribing to another package. This service does not store user payment information but relies on reputable third parties to process subscription payments.

All accounts with expired subscriptions would still have access to their data but would be prevented from adding new users, new forms or new form submissions for a number of days referred to as the grace period. The number of days that make up the grace period will depend on the account’s subscription package. At the end of the grace period we reserve the right to delete all data associated with an expired account. The primary user is responsible for backing up the account data before the grace period is over.


Account Content

The content of an account belong solely to that account and therefore the primary users or other user associated with an account have sole responsibility in this regard. We will only view an account data with the express permission of an active account user or in response to a specific law enforcement or copyright complaint. If these guarantees are not sufficient, this service provides mechanisms by which data once collected on a device are encrypted and can only be decrypted off-line. Thus, the data remains encrypted whether in transit or in the data store of this service. See this example for more information on form encryption.


Closing an Account

To close an account simply discontinue using the service and all data for accounts with expired subscriptions and grace period exceeded will be purged from the system at the discretion of the service administrators. Also note that accounts that violate the terms outlined in this document or Privacy Policy will be closed and subscription fees will not be refunded.


Service Maintenance

Whilst we reserve the right to pause this service at any time in order to carry out maintenance or upgrades, great effort will be made to ensure that such disruptions are kept to a bare minimum. Planned service maintenance will usually be restricted to Sunday mornings between 00:00 - 07:00 Coordinated Universal Time (UTC). There is no such time frame for unplanned service maintenance.


Trademark

Accepting this terms of service does not in any way, shape or form transfer the CCA System intellectual properties i.e., the CCA name, logo or names of associated applications to registered account holders or users or any third party. All non-third party trademarks, logos, graphics used by this service remain the property of CCA System.


Disclaimer of Warranties

This service is provided as-is, as-available and without any expressed or implied warranties from us. We do not guarantee that the service will be uninterrupted and error-free. You understand and acknowledge that you use this service at your own risk.


Limitations of Liability

To the maximum extent permitted by law and not withstanding any other provision of this terms of service, we shall not be liable for any direct, indirect, incidental, consequential, or special damages or losses, whether tangible or intangible, resulting from the authorized or unauthorized use or access to this service. We shall also not be liable for any amount which exceed the most recent 12 month subscription fee paid by you.


Changes to Terms of Service

We reserve the right to modify this terms of service (TOS) statement at any time. Changes to this document will be posted on this page and the date which it, i.e., TOS, takes effect at the top of this page.
